Bill 6,814\/17, which replaces the current Bidding Law (8,666 \/ 93) and modernizes the rules on contracts signed by public administration bodies, was the motto of the debate held on Tuesday (August 28th ,2018) morning, by the Special Committee on Bids and Administrative Contracts of the \u201cOAB \/ RJ\u201d, at the entity’s headquarters. The panel was composed of the President of \u201cCELCA\u201d, Paula Pincelli Tavares Vivacqua, members Glauber de Brittes Pereira and Bernardo Pedrete and the Chairman of the Arbitration Commission, Joaquim Muniz.<\/p>\n

The impacts of the Bill on the rules of the trading, the lack of capacity of the public agent that today acts as a crier, the relationship with insurance companies and the gap between theory and reality were some of the points raised in the meeting, which had active participation of the audience.<\/p>\n

The acquisitions of public power add up to billions of reais per year, so the measures to prevent deviations have been part of the agenda. The lawyers had approached the creation of the National Portal of Public Procurement (Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas \u2013 \u201cPNCP\u201d), one of the news of the new law, which should be established by the Federal Executive
\nPower and adopted by all the Powers of all entities (Union, States and Municipalities); the impact of Operation \u201cCar Wash\u201d, compliance standards and the gap between theory and reality.<\/p>\n

“CELCA\u201d wanted to start the analysis of the Bill so we could begin to reflect on the repercussion that this new law will bring to the market as a whole, as local and foreign companies participate in bidding processes\u201d, said Vivacqua.<\/p>\n

Pereira criticized what he called the Brazilian’s \u201caddiction\u201d of thinking that the law would be \u201csomething very difficult to implement\u201d and shared his experience in analyzing hiring of the National Cancer Institute.<\/p>\n<\/div>
